ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THE  JEN AND DAR EXPERIENCE LLC held during the duration of the RETREAT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I certify that I have no medical conditions that would prohibit me from participating in these activities offered throughout the entire duration of the RETREAT, and I have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these activities.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate and that it will govern my actions and responsibilities at said activity.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: The Jen and Dar Experience LLC and/or their directors, officers, employees, volunteers, good samaritan first-aid workers, representatives, and agents, and the activity holders, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that the JEN AND DAR EXPERIENCE LLC RETREAT and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I acknowledge that any free medical advice given by any good Samaritans during the Retreat does not constitute licensed medical practice in the state of the Retreat location.

I acknowledge that this activity may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants but are also present for volunteers.

I hereby consent to receive medical treatment which may be deemed advisable in the event of losing consciousness or sound mind during this activity.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

MEDIA CONSENT & RELEASE

Of course, you and your likeness will always be presented in the best possible light.

I understand while participating in any or all Retreat activities, I may be photographed or filmed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the Retreat holders, producers, sponsors, organizers, and assigns.

COVID-19 ASSUMPTION OF RISK WAIVER OF LIABILITY AND INDEMNIFICATION 

*Part 1 - 

ALL PARTICIPANTS must read, acknowledge, and agree to the waiver part 1 and part 2 listed below before attending this event. 

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is believed to spread mainly from person-to-person contact. The Jen and Dar Experience LLC cannot guarantee participants will not become infected when gathering at Retreats or participating in Retreat activities. 

By completing this waiver, you are acknowledging that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By attending this event, you and any guests voluntarily assume all risks related to exposure to COVID-19 and agree not to hold The Jen and Dar Experience LLC. or any of their affiliates, directors, officers, employees, agents, contractors, or volunteers liable for any illness or injury. 

The Jen and Dar Experience LLC in partnership with the venue remains committed to providing a safe and clean environment and upholding the highest standard of cleanliness and social guidelines at this event.

Part 2 -

In consideration for receiving permission to enter and remain on the premises, I hereby acknowledge and agree to the following:

1. Assumption of Risk. I understand the hazards of COVID-19. I agree that I am personally responsible for my safety and actions while attending the event. I agree to comply with all The Jen and Dar Experience LLC policies and rules, including but not limited to The Jen and Dar Experience LLC rules, guidelines, signage, and instructions. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in the event.

2. Waiver and Release of Liability. With full awareness and appreciation of the risks involved, I release, waive, discharge, and covenant not to sue The Jen and Dar Experience LLC, its officers, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party attending the event or on the premises, or otherwise, while participating in any activity while in, on, or around the premises.

3. Hold Harmless. I shall indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action brought, on appeal or otherwise), arising from or out of or relating to, directly or indirectly, the infection of COVID-19 and my attendance of the event.

4. Miscellaneous. This Agreement shall be governed by the laws of Texas. If any clause of this Agreement is held invalid, this Agreement is severable and the remainder of the Agreement will remain in effect, valid, and enforceable.

5. I acknowledge and represent that I have read the foregoing Wavier of liability and Hold Harmless Agreement, understand it, and sign it voluntarily; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this agreement for full, adequate and complete consideration fully intending to be bound by the same.

THE JEN AND DAR EXPERIENCE, LLC CANCELLATION POLICY

PAYMENT POLICY

Your reservation is secured upon deposit and completion of waiver and cancellation policy forms.

All payments are received in full by the start of the retreat. 

RETREAT CANCELLATIONS

It is your responsibility to read and understand our cancellation policy before making a reservation.

Naturally, no one books with the intention of canceling or postponing their retreat, but unexpected things do happen, so please purchase travel cancellation insurance once you have made your reservation.

DEFINITIONS

“Cancellation” is defined as not attending your scheduled retreat, including postponing or rescheduling.

“You” refers to the guest booking the retreat.

“We” refers to The Jen and Dar Experience LLC.

TRAVEL AND CANCELLATION INSURANCE

To join the retreat it is highly recommended that you secure travel insurance. Please be sure that your insurance policy covers you for all relevant OUTDOOR ACTIVITIES you will be engaging in on your retreat & TRIP CANCELLATION.

Depending on the policy and conditions, travel cancellation insurance will pay for some or all cancellation fees.

With most agencies, insurance must be purchased within 14 days of making your reservation.

GUEST CANCELLATION POLICY

All cancellations will incur a $100 cancellation fee.

If you cancel your trip 91-180 days before the retreat start date, you will receive a 50% refund.

If you cancel your trip 90 days or less before the retreat start date, there is no refund.

Exceptions to our policy cannot be made for any reason. We do not offer credit for a guest arriving late or leaving early. You must submit your signed Waiver form within one week of booking. Guests who fail to do so may be subject to an automatic cancellation and the above policy will apply.

While we have never canceled a retreat to date, if a retreat is canceled for any reason, you may transfer your full retreat payment to another retreat, or you may request a refund of your payment to us, constituting a full settlement.

THE JEN AND DAR EXPERIENCE, LLC is not responsible for your expenses incurred in preparation for any canceled retreat, such as airline tickets, loss of work, and/or other costs associated with preparing for your trip.
